					</table><p>The Ministry of New and Renewable Energy (<a href="https://mnre.gov.in/en/" target="_blank" rel="noopener">MNRE</a>) has advised renewable energy implementing agencies (REIAs) and other power procuring agencies to consider granting an extension of up to four months to renewable energy projects affected by disruptions arising from the situation in West Asia.</p>
<p>The relief can be considered for projects whose Scheduled Commencement of Supply Date (SCSD) or Scheduled Commissioning Date (SCD), including an already extended SCSD or SCD, falls on or after February 28, 2026.</p>
<p>The extension must be granted in accordance with the force majeure provisions of the respective power purchase agreements (PPAs) and the prescribed procedure for seeking such relief.</p>
<p>The advisory applies to REIAs, including the Solar Energy Corporation of India (SECI), NTPC, NHPC, and SJVN, as well as power, energy, and renewable energy departments of state and Union Territory governments and organizations and agencies under them.</p>
<p>MNRE has also requested the Ministry of Power to issue orders providing similar relief to affected renewable energy developers by extending or providing General Network Access (GNA) and connectivity without any penalty. It has further sought continuation of the applicable interstate transmission system (ISTS) waiver or concession during the extended project period.</p>
<p>The Ministry has separately requested the Central Transmission Utility of India to take similar action regarding GNA and connectivity.</p>
<p><strong>West Asia Situation as Force Majeure</strong></p>
<p>The latest advisory follows an earlier MNRE communication dated July 6, 2026, which asked REIAs and state and Union Territory authorities to consider the Ministry of Finance&#8217;s April 29, 2026, office memorandum while deciding developers&#8217; requests for extensions due to disruptions arising from the West Asia situation.</p>
<p>The Department of Expenditure had clarified that the ongoing West Asia situation should be treated as ‘war,’ which is recognized as an event triggering force majeure under government procurement rules.</p>
<p>Where disruptions arising from the situation have directly or consequentially affected contractual obligations relating to goods and services or construction and works contracts with government agencies, procuring entities can invoke force majeure.</p>
<p>Under the Finance Ministry&#8217;s memorandum, contractual obligations due for completion on or after February 28, 2026, may be extended by at least two months and no more than four months without imposing costs or penalties on the contractor.</p>
<p>However, the parties may invoke force majeure only if they were not already in default of their contractual obligations as of February 27, 2026. The relief also applies only to non-performance directly attributable to disruptions caused by the West Asia situation.</p>
<p><strong>No Blanket Extension</strong></p>
<p>MNRE issued the latest clarification after receiving further representations seeking a blanket extension of project timelines for affected renewable energy projects.</p>
<p>These representations cited an advisory from the Ministry of Housing and Urban Affairs, which had advised real estate regulatory authorities that they could extend the registration and corresponding completion timelines of eligible registered real estate projects by four months.</p>
<p>MNRE, however, noted that the standard bidding guidelines for procuring solar, wind, hybrid, and firm and dispatchable renewable energy power require PPAs to contain provisions defining force majeure events and specifying the exclusions, applicability, and relief available in such circumstances.</p>
<p>The Ministry also noted that PPAs generally recognize war as a force majeure event. Accordingly, rather than providing a blanket extension, MNRE has advised the concerned agencies to consider extensions under the force majeure provisions of individual PPAs and the applicable contractual procedure.</p>
<p>In July, MNRE <a href="https://www.mercomindia.com/mnre-withdraws-almm-list-i-transition-relief-for-delayed-solar-projects" target="_blank" rel="noopener">withdrew</a> transitional relief for certain solar projects that could not comply with the ALMM List-I requirement due to commissioning delays beyond the developers’ control.</p>

MNRE Allows Four-Month Extension for Renewable Projects Hit by West Asia Crisis

					</table><p>The Central Electricity Regulatory Commission (<a href="https://cercind.gov.in/index-en.html" target="_blank" rel="noopener">CERC</a>) has proposed a one-time framework to deal with renewable energy projects that secured transmission connectivity under the General Network Access (GNA) regulations on the basis of Letters of Award (LoAs), but where power purchase agreements (PPAs) have not been signed within 12 months.</p>
<p>The Commission observed that connectivity should be allocated only to entities with firm commitments and project readiness.</p>
<p>In its draft order, the CERC proposed three options for affected developers:</p>
<ul>
<li>Under Option I, entities may opt to exit from the LoA route and set up the project by submitting a performance bank guarantee (PBG) of ₹1 million (₹10,557)/MW and submitting the land document, the financial closure document, and the scheduled commercial operation date (SCOD) within the prescribed timeline.</li>
<li>Under Option II, developers may substitute the original LoA with a PPA signed under another LoA issued by the same or a different Renewable Energy Implementing Agency (REIA).</li>
<li>Under Option III, entities may surrender connectivity and receive the return of Conn-Bank Guarantee (BG)1, Conn-BG2, and Conn-BG3, after which the surrendered connectivity would be auctioned by the Central Transmission Utility of India (CTUIL).</li>
</ul>
<p>Stakeholders have until May 21, 2026, to submit their feedback.</p>
<p><strong>Background </strong></p>
<p>CERC noted that the GNA Regulations allowed renewable energy generating stations to obtain connectivity based on LoAs issued by REIAs.</p>
<p>The framework was introduced with the expectation that such LoAs would eventually convert into PPAs and power sale agreements (PSAs).</p>
<p>However, the Commission found that a large quantum of connectivity granted through the LoA route had not resulted in signed PPAs. As a result, several projects had failed to progress despite occupying valuable transmission capacity.</p>
<p>To address the issue, CERC issued a staff paper on November 25, 2025, proposing three alternatives: permitting developers to exit the LoA route without surrendering connectivity, allowing substitution of LoAs with other PPAs, or surrendering and auctioning the connectivity.</p>
<p>Around 30 stakeholders submitted comments on the proposals. The Ministry of Power recommended permitting a one-time surrender of connectivity without forfeiture of bank guarantees for legacy LoAs where PPAs or PSAs had not materialized.</p>
<p>The Ministry also suggested reallocating the freed-up connectivity through a transparent auction mechanism and assigning the auction revenue to CTUIL.</p>
<p>Some stakeholders opposed the proposal for additional PBG requirements, arguing that such financial conditions would create barriers for smaller developers.</p>
<p>Others sought longer timelines for project commissioning, land document submission, and financial closure.</p>
<p>At the same time, some stakeholders supported auction-based allocation of connectivity, stating that it would improve utilization of transmission infrastructure.</p>
<p><strong>Commission’s Analysis </strong></p>
<p>CERC opined that connectivity obtained through LoAs should not remain blocked indefinitely where PPAs have not been signed for over 12 months.</p>
<p>It proposed a three-way mechanism for developers affected by delays in signing PPAs.</p>
<p>Under the proposed framework, surrendered connectivity under Option III would first be offered through a reallocation process and, if unallocated, auctioned by CTUIL. The auction would proceed by increasing bids, with the highest bid above the base price winning the allocation. The Commission proposed a base auction price of ₹300,000 (~$3,167)/MW.</p>
<p>The draft order proposes that bidders would have to pay a non-refundable application fee of ₹500,000 (~$5,279) plus applicable taxes and furnish an earnest money deposit (EMD) of ₹15,000 (~$158.36)/MW, equivalent to 5% of the base price, in the form of a bank guarantee.</p>
<p>Successful bidders would be required to deposit the bid amount in cash and furnish a PBG of ₹30,000 (~$316.72)/MW, equal to 10% of the base price, within 15 days of conclusion of the bidding process.</p>
<p>Failure to furnish the bid amount or the PBG within the stipulated timeline would lead to revocation of the awarded connectivity and encashment of the EMD.</p>
<p>The Commission also laid down timelines for land acquisition, financial closure, and achievement of commercial operation.</p>
<p>Where the substation and associated transmission augmentation have already achieved commercial operation, the commissioning date of the project cannot exceed 12 months from the date of award of connectivity.</p>
<p>Land documents must be submitted at least nine months before SCOD, while financial closure documents must be furnished at least six months before SCOD.</p>
<p>For projects where the substation or associated augmentation is still under construction, the SCOD cannot exceed 24 months from the award or start date of connectivity, whichever is later.</p>
<p>Developers must furnish land documents within 12 months of the award of connectivity or within nine months of the communication of tentative substation coordinates, whichever is later.</p>
<p>Financial closure documents must be submitted within 15 months of the award of connectivity or within one month of the connectivity start date, whichever is later.</p>
<p>The Commission has proposed allowing limited extensions upon payment of milestone extension charges. Developers may seek up to three additional months for submitting land documents, up to three additional months for financial closure, and up to six additional months to achieve commissioning.</p>
<p>However, if developers fail to meet land acquisition or financial closure milestones within the prescribed or extended timelines, connectivity would be revoked under the GNA Regulations, and the PBG would be encashed.</p>
<p>Similarly, if developers fail to achieve commissioning for part or full project capacity within the stipulated or extended timelines, connectivity corresponding to the delayed quantum would be revoked, and the proportionate PBG would be encashed.</p>
<p>The Commission directed REIAs to submit details of LoAs in which PPAs remain unsigned for more than 12 months, and instructed CTUIL to furnish the corresponding connectivity status.</p>
<p>Recently, CERC <a href="https://www.mercomindia.com/cerc-rulestransmission-charges-apply-partial-project-commissioning" target="_blank" rel="noopener">held</a> that renewable energy generators are liable to pay bilateral transmission charges for the associated transmission system until their projects achieve commercial operation. It rejected their request to quash the invoices issued by the CTUIL.</p>

CERC Proposes Exit, Auction of Stalled Renewable Projects with Grid Connectivity

					</table><p>The Ministry of New and Renewable Energy (<a href="https://mnre.gov.in/en/" target="_blank" rel="noopener">MNRE</a>) has designated the Solar Energy Corporation of India (<a href="https://www.seci.co.in/" target="_blank" rel="noopener">SECI</a>) as the sole renewable energy implementing agency (REIA) for issuing renewable energy procurement bids as an intermediary procurer.</p>
<p>However, other REIAs will continue to manage and fulfill obligations related to bids already issued by them, including ensuring the signing of power sale agreements (PSAs) and power purchase agreements (PPAs) for projects for which letters of award (LoAs) have been granted.</p>
<p>The Ministry issued a set of directions to the four REIAs &#8212; SECI, NTPC, NHPC, and SJVN &#8212; to address delays in executing PSAs and PPAs.</p>
<p>To address delays in PSA execution, MNRE has directed REIAs to review all pending cases in which LoAs have been issued, but PSAs remain unsigned for extended periods.</p>
<p>These cases must be categorized into those where PSA signing is likely and those where it appears difficult or unlikely. For projects in the latter category, particularly where developers have not applied for connectivity through prescribed routes, the REIAs will initiate appropriate actions, including cancellation of LoAs, in line with standard bidding guidelines and tender provisions.</p>
<p>Last November, the government <a href="https://www.mercomindia.com/government-to-cancel-reia-awarded-projects-without-ppa-psa-prospects" target="_blank" rel="noopener">directed</a> REIAs to close all legacy bids and cancel the LoAs for all renewable energy projects for which PPAs and PSAs were not feasible by November 30, 2025. The four REIAs together had unsigned PPAs/PSAs for 42 GW of projects.</p>
<p>The MNRE has also emphasized improving market discipline and bid efficiency by directing that post-tender negotiations to modify discovered tariffs should be discouraged.</p>
<p>Additionally, before issuing new bids, REIAs must engage with states and procurers to assess actual power demand, including peak requirements, and secure procurement commitments in advance to avoid supply-demand mismatches.</p>
<p>Further, the order notes that REIAs should not include a greenshoe option in bids without prior approval from the appropriate regulatory commission, ensuring adherence to bidding guidelines.</p>
<p>In June last year, the Ministry of Power had <a href="https://www.mercomindia.com/terms-designate-renewable-energy-implementing-agencies" target="_blank" rel="noopener">stated</a> that Indian companies registered under the Companies Act, 2013, and holding a valid Category-I electricity trading license are eligible to become REIA if they have a net worth exceeding ₹5 billion (~$58.24 million) and a long-term credit rating of A or above. The net worth must exclude revaluation reserves.</p>
